Cancellation Policy

 

Classes must reach their minimum number of students 45 calendar days before the class start date. From there, classes that have met minimum enrollment will remain open until they reach their maximum number or one to two weeks prior to the class start date.

If the Art Colony needs to cancel a class due to instructor illness or other unforeseen reason, students will be informed at least five (5) business days before the start date (unless otherwise noted) and the Art Colony will refund tuition payment in full. Should the Art Colony need to cancel a class due to COVID-19 students will receive a total refund.

The Art Colony assumes no responsibility for losses incurred due to lodging or travel arrangements (you may want to consider travel insurance and confirm the cancellation policy of your lodging accommodations).

Adult Class Cancellation Policy

Upon registration a 25% non-refundable deposit is applied. Students who have paid full tuition and supply fees and cancel 45 days or more in advance of the class start will receive a full refund minus the non-refundable deposit. Students who have only paid the deposit are not eligible for a refund.  

No refunds are given within 45 calendar days of the class start date, but students do have the option to transfer their tuition payment to another class for a $100 fee.

If the Art Colony cancels a class, students will be refunded in full.

Youth Class Cancellation Policy

Students who cancel more than 14 calendar days in advance of the class start date will receive a full refund. No refunds are given within 14 calendar days of the class start date.

Entry Points Cancellation Policy

Students who cancel more than 14 calendar days in advance of the class start date will receive a full refund. No refunds are given within 14 calendar days of the class start date.

Readers and Writers Festival Cancellation Policy

Upon registration a 25% non-refundable deposit is applied. Students who have paid full tuition and supply fees and cancel 14 days or more in advance of the class start will receive a full refund minus the non-refundable deposit.

ASSUMPTION OF RISK & WAIVER – GENERAL

 

As a student you recognize that your participation, involvement and / or attendance at any Grand Marais Arts, Inc. dba Grand Marais Art Colony, hereinafter “Art Colony”, activity (“Activity”) is voluntary and involves hazards and risks that may result in personal injury, illness or death and/or property damage. I hereby acknowledge such hazards and risks and accept them as part of the program in which I am participating. These risks may include, but are not limited to, the use of hand and power tools, the use of sharp and/or hot materials and equipment, the use of kilns, and the use of chemicals. I agree to only use the equipment and tools I have been approved to and trained to use.

By attending, observing or participating in the Activity, You acknowledge and assume all risks and dangers associated with your participation and / or attendance at the Activity, and You agree that:

  1. the Grand Marais Art Colony;
  2. the property or site owner of the Activity; and,
  3. all past, present and future affiliates, successors, assigns, employees,
    volunteers, vendors, partners, directors, and officers, of such entities
    (subsections (a) through (c), collectively, the “Released Parties”),

will not be responsible for any personal injury (including death), property damage, or other loss suffered as a result of your participation in, attendance at, and / or observation of the Activity, regardless if any such injuries or losses are caused by the negligence of any of the Released Parties (collectively, the “Released Claims”).

By attending and / or participating in the class or activity, you are deemed to have given a full release of liability to the Released Parties to the fullest extent permitted by law.

By signing this release, I also give my consent to the Art Colony to use program photos and videos that include me for promotional purposes, forgoing any compensation or ownership of such materials.

Assumption of Risk and Waiver – CORONAVIRUS (COVID-19)

COVID-19 SAFETY INFORMATION

The COVID-19 virus is a serious and highly contagious disease. The World Health Organization has classified it as a pandemic. You could contract COVID-19 from a variety of sources. The COVID-19 virus has a long incubation period. You or other users of the Art Colony studios may have the virus and not show symptoms yet be highly contagious. You may contract COVID-19 while using an Art Colony studio as a result of the virus being present within the environment. The COVID-19 virus may cause severe illness and death.

While participating in events held or sponsored by the Grand Marais Art Colony (“GMAC”), consistent with CDC guidelines, students are asked to practice comply with the most recent recommendations from the MDH to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, GMAC has put in place preventative measures to reduce the spread of COVID-19.

However, GMAC cannot guarantee that its students, instructors, volunteers, partners, or others in attendance will not become infected with COVID-19.

COVID-19 Safety Protocol

In order to ensure the health and safety of our students, artists-in-residence, instructors, visitors, and staff, we are observing the following COVID-19 protocols:

  • When our community is at HIGH according to our local public health department, masks are required to be worn in all Art Colony buildings and at any indoor off-site programs. We recommend wearing an N95, KN95, or KF94 mask for the best protection. Please refer to the instructions posted in each studio about how to wear a mask properly.
    – At other times masks are optional.
  • The Art Colony will utilize air filtration units in studios and will open doors and windows for natural ventilation when possible.
  • Students agree to self-monitor for signs and symptoms of COVID-19. Symptoms of COVID-19 can be found at this link.
  • If you are experiencing symptoms of COVID-19 or have been in recent contact with anyone who has tested positive for COVID-19, please stay home.

  • Anyone who develops symptoms of COVID-19 within five (5) days of participating in Art Colony programming, is expected to contact us at info@grandmaraisartcolony.org.
  • The Art Colony reserves the right to terminate access to studio space for any or all participants if it determines that our safety protocols have not been followed, or that the safety and health of staff, students, the instructor, and others may be at risk.

COVID-19 remains a moving target and we continue to consult with our local public health professionals as to how to manage our safety plan. We appreciate your support and resilience as we all do our best to create a safe place to learn and explore art.

The Art Colony will make the following supplies available in all studios:

  • Hand sanitizer
  • Anti-bacterial surface cleaner
  • Additional masks
  • Air filtration units
  • Natural ventilation when possible

ASSUMPTION OF RISK – COVID-19

I acknowledge and understand the following:

  • Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist;
  • I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault of the Released Parties;
  • I hereby knowingly assume the risk of injury, harm and loss associated with the Activity, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of the Released Parties;

I confirm that I have read the Student Agreement set forth above and I understand and accept the risk of contracting the COVID-19 virus while using studio space. I agree to release the Grand Marais Art Colony from any liability arising from me contracting the COVID-19 virus and I waive all claims that I, my heirs, or any personal representatives may have against the Art Colony with respect to me contracting COVID-19. This liability waiver and release extends to all staff, employees, volunteers, and board members of the Art Colony

We use this information to manage our classes, process transactions at checkout, inform you about upcoming classes or other opportunities by email and physical mailings, and inform you about donation opportunities.

Class Attendees – Contact Information

Adult Classes

All attendees registering for an adult class will be asked to provide the following information: Name, Email Address, Telephone, Accessibility Needs, Member Status, and Acknowledgement of the Terms & Conditions.

We use this information to contact you regarding the class, provide a suitable experience for attendees with accessibility needs, view statistics about class attendance trends, and make sure you understand the terms and conditions before checking out.

Contact Information from the account holder will also be collected and associated with this class registration. We use this information to generate trend reports.

Note: Each time you register for a class, you will automatically be subscribed (or re-subscribed) to our marketing emails. However, you may opt-out of marketing emails at any time by clicking the Unsubscribe link in the footer. Even if you opt-out of marketing emails, you will still receive emails relevant to classes you have registered for.

Cookies

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

When you make a purchase on our site, a couple cookies are set to prevent fraud, and process your transaction without storing credit card information on our servers. (See the Credit Card Information section below for more information).

Where we send your data

We send data through an API automation service to a Customer Relations Management service and email marketing service.

Credit Card Information

We never store any credit card information on our website. Your payment information is passed securely and directly to Stripe, our payment processor. If you choose to save your credit card information to your account, your credit card information is stored with Stripe, never on our website.

All Apple Pay and Google Pay payments are also processed by Stripe.

When processing payments, we pass the following information to Stripe: Name, Email, Address, Phone, City/State/Zip, Unique payment identifier, Payment provider identifier.

Aggregated Statistics

Grand Marais Art Colony may collect statistics about the behavior of visitors to its websites. Grand Marais Art Colony may display this information publicly or provide it to others. However, Grand Marais Art Colony does not disclose personally-identifying information other than as described below.
